AUSTIN (AP) – A state lawmaker has introduced legislation that would allow football coach Mike Leach to sue Texas Tech for wrongful dismissal.
State Rep. Craig Eiland filed the resolution Friday, on the last possible day allowed under House rules.
Texas Tech fired Mike Leach in December 2009 for mishandling a player with a suspected concussion. He has since sued the university for damages, plus an $800,000 bonus he was to be paid the next day. But the university argues that it has immunity because it is a state institution. If passed, the resolution Eiland introduced would make that argument moot and clear the way for the lawsuit.
