Maypearl Man Gets 20 Years Jail For Walmart Indecency

WAXAHACHIE (AP) – A man has been sentenced to 20 years in prison for assaulting a 7-year-old boy in the toy section of a Dallas-area retail store.

Prosecutors in Ellis County on Monday announced the penalty for 39-year-old Phillip Wayne Waller of Maypearl.

A jury in Waxahachie convicted Waller of indecency with a child over the October 2010 incident. He received the maximum penalty Nov. 9.

The victim’s father testified he briefly left his older boy in the toy section of a Walmart in Midlothian while taking his 4-year-old son to the bathroom. The father says he returned to find Waller was pressed up against the victim.

Midlothian police say Waller fled but was chased by store employees, who turned in a description of his car. Waller was later arrested.

    You should NEVER leave your children in any store unsupervised. The father should have have taken his seven year old son with him to the bathroom. I’m sorry for what happened to the little boy, thank God he wasn’t killed or kidnapped. Parents, please Never leave your children alone in public places, nor in vehicles.

    So why wasn’t the father also charged with child endangerment for leaving the little 7 year old alone for this to happen?

    I know the guy that was convicted and this isn’t what happened. This is what was claimed to have happened by the kids father. no one else was there and no camera shots from the vast multitude of cameras that wally world has were used. This was nothing more than a witch hunt by a bunch of “good old boys” Mr. Waller spent a great deal of time in his life helping out kids and serving in church and wouldn’t ever hurt anyone. I would be much more worried about some guy that leave one child alone in a big store like wal mart while he tales another to the bathroom, bet we hear from his family again.

      A familiy friend: I’m sure that day the kid’s father decided that he was going to go to wal mart and find a complete stranger and accuse him of trying to sexually assault his son. I’m also sure he told his son to go along with the story and put an innocent man behind bars. I’m also sure the cops and the judge were all in on it and that’s why he’s behind bars. Sorry to say it (NOT) but your “friend” seems to have issues with little boys and you’d better be prepared if other kids suddenly come forward to say that their parents also decided to ruin an innocent man’s life one day, too.

    Why did he run if he was innocent. Pedophiles always come across as upstanding people. They gain the parents trust in order to abuse. Look at the reports about the Penn State coach.
