GEORGETOWN (CBSDFW.COM/AP) — A judge is holding a hearing on whether an ex-prosecutor should face a formal investigation into allegations he hid evidence and wrongfully sent a man to prison for nearly 25 years.

Michael Morton was freed last fall after DNA tests implicated someone else in the 1986 murder of his wife Christine.  She was beaten to death in her bed.  Prosecutors said her husband killed her after she refused his sexual advances.

Morton’s attorneys are seeking a court of inquiry on charges the prosecutor in Morton’s trial, Ken Anderson, concealed evidence from the defense.

Now a state district judge, Anderson has apologized for “the “system’s failure” in the Morton case.

Courts of inquiry are used in cases of official misconduct.

Another district Judge, John Harle, may announce during Friday’s hearing in Georgetown if a court of inquiry should proceed.

Police recently arrested a new suspect, Mark Norwood, in Christine Morton’s slaying.  Norwood is also a suspect in the murder of another woman who was beaten to death in her bed.
