DALLAS (1080 KRLD) – Residents of the East Village Association are suing the city of Dallas over the plan to build a Sam’s Club in the area of Haskell and Central Expressway, and now the The 5th Circuit Court of Appeals in Dallas is keeping the fight alive.

Residents complained loudly that the deal was rammed through without their knowledge and they never had a chance to fight the developer at the hearing.

The city has been fighting the association on a number of levels – the most important trying to get the whole lawsuit dismissed on grounds the Association has standing.

On Thursday morning the Appeals Court ruled the Association not only is real, it has the right to continue the lawsuit to block the entire project.

Now it goes back to a Dallas County judge and the fight will continue.

A former attorney for the Association has threatened to make the developer tear down any buildings if the courts rule in their favor.

The lot has been empty for about 6 months.
