UT Asks State Supreme Court To Dismiss Suit

AUSTIN (AP) – The University of Texas has asked the Texas State Supreme Court to block a discrimination lawsuit.

Former women’s track coach Beverly Kearney filed a suit claiming sex and race discrimination. Kearney was forced out in 2013 after the school learned about a romantic relationship with one of her athletes a decade earlier.

In 2014, she sued arguing that, as a black woman, she was held to tougher standard than a white male coach and other school officials who she alleges were in relationships with subordinates.

So far, two lower courts have allowed her case to proceed.

The university’s recent appeal says Kearney’s evidence does not support her discrimination claims. The school also says her case would change the legal standards used for when state agencies could be sued.
