THE COLONY (CBSDFW.COM) –  No charges will be filed against a grandmother who was driving at the time her grandson was ejected from her moving car and killed.

Police say one of the tires on Anastacia Galindez’s Toyota 4 Runner blew out earlier this month, causing her to lose control, cross traffic and hit a guardrail.  After the accident, Galindez realized her grandson, Ismael Galindez III, was missing from the backseat.  Police later found the three-year-old dead and determined he had been ejected from the car after the accident.

Galindez was on her way home to Frisco after picking up the toddler from Carrollton.  Relatives told police they watched Galindez buckle Ismael into the child safety seat, but that he had a habit of unbuckling the seat.

Colony Police are waiting for a final cause of death from the Tarrant County Medical Examiner before officially closing the case.
