DALLAS (CBS 11 NEWS) – A 70-year-old man severely beaten near a popular Dallas restaurant earlier this year has filed a $1 million dollar lawsuit.  Luis Rocha, Sr. was attacked after leaving Campisi’s restaurant on Greenville in January.

Three attackers kicked and beat Rocha, leaving him for dead in a nearby parking lot.  They have still not been caught.

“From one minute, I was fine,” says Rocha, “and within seconds I couldn’t take care of my own natural body functions.  I was made a child overnight.”

Rocha at times choked back tears as he faced reporters today to talk about the lawsuit.  The suit claims inadequate lighting and no security in the overflow parking area contributed to the attack.

The property owners of the shopping center are also named in the lawsuit.  Rocha in the lawsuit claims that he has been left in “financial ruin” because of the medical bills related to the attack and his inability to work.

At the time of the attack, Campisi’s owner released a statement calling Rocha a loyal friend and customer.  The statement expressed regret that the attack happened nearby; but, stressed that Rocha was not attacked in their parking lot.
