Police union officials say an arbitrator ruled in favor of Matt Fisher and Wes Allen, who learned of the decision Wednesday.
Arlington police arrested Jonathan Paul on outstanding warrants in March of 2015 after getting a call about a disturbance. Once at the jail, video showed Paul yelling, taking off his clothes, flooding a bathroom and not listening to commands. He was restrained and sprayed him with pepper spray.
Paul collapsed and was hospitalized. He died four days after his arrest. An autopsy determined the restraints, pepper spray and Paul’s acute psychosis contributed to his death.
Two other now-former jailers await trial on criminally negligent homicide charges.
The Arlington City Council in April approved paying a $1.25 million settlement to Paul’s relatives.
