It happened at about 3:00 Thursday morning at The Flats at Five Mile Creek Apartments.

“I was woken up out of my sleep by a gunshot,” recalled Billie Rudd, a resident at the apartment complex. “They were beating on the driver side window and next thing I know they opened up the door, they pulled him out of the truck and put him on a stretcher.”

Dallas police say they do not know why Lemons got into the truck, or his intentions. The tow truck driver was at the apartment complex looking for parking violators, but Lemon’s car was not parked near the tow truck.

The tow truck driver has not been identified.

Dallas Police Major Jeff Cotner says the driver’s company, United Tow of Dallas, had an arrangement with the apartment complex to tow parking violators.

The tow truck driver presented a Arizona concealed handgun license to police.

Major Cotner said, “We are now working with authorities to determine if Texas recognizes that. Again, we’re investigating whether or not he had a provision within the statues to protect his property from theft at nighttime.”
